A high court in Abuja has cleared Andy Uba, senator representing Anambra south, of a certificate forgery charge.

The suit was filed by one Uchenna Nnadi, who challenged Uba’s West African Examinations Council (WAEC) certificate and his eligibility to hold public office.

But ruling on the suit on Friday, Valentine Ashi, the judge, held that Nnadi failed to prove that Uba’s certificate was forged.

Ashi said according to law, the burden of proof was on the plaintiff “who failed to provide any evidence of forgery”.

The judge said Nnadi should have investigated and cross checked his facts with the Independent National Electoral Commission (INEC), which cleared the senator as being eligible to hold any public office.

He noted that Uba had been using the same certificate since 2007 without any alteration.

Dismissing the suit, the judge said the election forms submitted to INEC for the elections he had participated in does not have any alteration.
