Court quashes suit seeking disqualification of Rivers PDP guber candidate

A federal high court in Port Harcourt has dismissed a suit seeking to disqualify Siminalaye Fubara as governorship candidate of the Peoples Democratic Party (PDP) in the 2023 elections.

Fubara had resigned as Rivers state account-general to enable him pursue his governorship bid.

On May 25, he polled 721 votes to defeat Isaac Kamalu, a former commissioner for finance in the state, who scored 86 at the primary election of the party in Port Harcourt.

Felix Obua, another aspirant, got two votes, while David Brigs secured four votes, and West Morgan had four. Tammy Danagogo polled 36 and George Kelly had 37 votes.

Aggrieved by the outcome, West had challenged Fubara’s candidacy, alleging he was not a member of the party and did not have a valid PDP membership card, among other issues.

Delivering judgment on Friday, Adamu Mohammed, the presiding judge, dismissed the suit.

The judge held that the suit is incompetent and that the court lacks the jurisdiction to hear it.
