Court threatens to strike out EFCC case over failure to produce witnesses

The federal high court in Enugu has given the Economic and Financial Crimes Commission (EFCC) till November 1 to produce witnesses to a case it filed three years ago.

On October 7, 2013, the EFCC arraigned one Anthony Ubosi on a two-count charge of conspiracy and obtaining under false pretence.

Chika Nwagu, defence counsel, had applied that the case be struck out because since inception, the prosecution had failed to produce a single witness in court.

“Every adjourned date, the story has always been unavailability of witness and this has taken almost four years,” Nwagu said.

The judge ordered the EFCC to produce its witnesses on the next adjourned date, and threatened that the court would strike out the case if it failed.

The case was adjourned till Nov. 1 for hearing.
