The appeal court has upheld the ruling of James Tsoho, justice of the federal high court, Abuja, refusing Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), bail.
A three-man panel led by Abdul Aboki held that the lower court was right in denying Kanu bail considering the nature and the circumstances of his case.
“The lower court has the power to exercise its discretion on the matter and the exercise of such discretion by the trial judge did not amount to denial of fair hearing to the defendants,” the court held.
“The issues are resolved against the appellants. Ruling of the trial court is hereby upheld.”
Chuks Muoma (SAN), Kanu’s lead counsel, had filed an appeal challenging the ruling of the high court.

He had argued that the lower court erred by denying his client bail.
But the appeal court on Wednesday held that the high court was right in its decision.
Ifeanyi Ejiofor, one of Kanu’s lawyer, had at news conference described his client as a political prisoner.

He had alleged that President Muhammadu Buhari was influencing judges to convict Kanu.
Kanu is facing a six-count of treasonable felony at the high court.
