The Kaduna governorship election tribunal has dismissed the petition filed by the Peoples Democratic Party (PDP) and its candidate in the 2023 election, Isah Ashiru, against the victory of Uba Sani, the state governor.
The three-member panel headed by Victor Oviawie, dismissed the petition on the grounds that the pre-hearing notice was filed out of time and therefore considered abandoned.
The tribunal affirmed that the petition was filed on April 10, 2023.
Two members of the panel held that the appeal brought by PDP and Ashiru against the dismissal of their petition at the preliminary stage by the first and second defendants was lacking in merit.

The tribunal noted that had the petition not been dismissed for lacking in merit, it would have ordered a supplementary vote in 22 polling units within 90 days in the substantive judgment.
The PDP and its candidate are challenging the declaration of Sani, candidate of the All Progressives Congress (APC), as winner of the March 18 governorship election.
The electoral umpire had declared that Sani secured 730, 001 votes to defeat his closest rival Ashiru of the PDP who scored 719, 196 votes.
